MedJets Faces Wrongful Death Lawsuit Over Fatal Learjet Crash

MedJets, operating as Jet Rescue Air Ambulance, is facing a wrongful death lawsuit in Palm Beach County Circuit Court, Florida, following the fatal crash of a Learjet 35(A) air ambulance in Cuernavaca, Mexico, on November 1, 2023. The accident resulted in the deaths of four people.

Filed on February 4, 2025, the lawsuit seeks $50,000 in damages on behalf of the estates and families of pilot Gerardo Alvarez Diaz and paramedic Mario Alberto Leon, both of whom perished in the crash.

According to court documents, the Learjet, registered as XA-IRE (msn 35A-354), departed Toluca before attempting to land at Cuernavaca. The aircraft overran the runway, crashed into a wooded area, and exploded, killing all on board. The plaintiffs allege that MedJets, which owned and maintained the aircraft, failed to ensure its airworthiness.

The lawsuit claims that a failure in the braking or landing system, caused by MedJets’ negligence, directly contributed to the crash. Allegations include improper aircraft maintenance, failure to update manuals, and inadequate mechanic training and certification.

The plaintiffs argue that MedJets breached its duty of care by failing to uphold aviation safety standards. They are seeking a jury trial to determine liability and recover damages for the victims’ families.

As legal proceedings unfold, the case raises concerns over aircraft maintenance practices in the air ambulance industry and the responsibilities of charter operators in ensuring passenger and crew safety.
