Mother Files Lawsuit Against Southwest Airlines Over Wrongful Trafficking Accusation

In a recent legal development, a mother has initiated legal action against US budget carrier Southwest Airlines, following a distressing incident where she was erroneously implicated in trafficking her own daughter.

Mary MacCarthy, accompanied by her then 10-year-old daughter, was en route from Los Angeles International Airport (LAX) to Denver International Airport (DEN) in October 2021 to attend a family funeral.

The situation took an unexpected turn when a Southwest flight attendant raised concerns with the Denver Police Department, suggesting that MacCarthy might be involved in child trafficking. The attendant’s suspicion reportedly stemmed from the visual disparity in skin color between MacCarthy, who is of Caucasian descent, and her biracial daughter.

According to legal records, the flight attendant did not engage in any communication with MacCarthy or her daughter throughout the flight.

Upon disembarking at DEN Airport, MacCarthy and her daughter were met by Denver law enforcement officers who subjected her to thorough questioning. The ordeal took a toll on both the mother and daughter, resulting in intense emotional distress amplified by the racial profiling.

The incident exacerbated MacCarthy’s already challenging circumstances due to a recent family bereavement, causing further strain.

The lawsuit emphasizes that such scenarios are regrettably common for mixed-race and minority families while traveling. MacCarthy is seeking unspecified compensatory damages for the emotional anguish inflicted, alongside coverage of legal expenses. Furthermore, she aims to prompt alterations in Southwest’s passenger profiling procedures and training protocols.
