VistaJet Malta Fights for EU Trademark Despite Legal Setback

VistaJet Malta remains determined to secure a European Union trademark for the distinctive red stripe on its silver fuselage, despite a recent legal setback. The EU General Court dismissed the airline’s appeal on February 5, upholding the European Union Intellectual Property Office’s (EUIPO) earlier decision to reject the application.

VistaJet initially filed for the trademark in September 2022, but the application was denied in May 2023 for lacking distinctive character under EU regulations. The Board of Appeal later rejected the airline’s appeal, and the General Court concurred, deeming the red stripe decorative rather than a recognizable brand element.

In response, a VistaJet spokesperson emphasized that the ruling focused on a narrow legal point rather than a complete rejection. “The recent EU submission concerned a very narrow point of law. It does not mean the mark was rejected. We just need to tailor our application to align with local requirements,” the spokesperson explained to Private Jet Card Comparisons.

The company plans to revise its application and continue the process. VistaJet has already successfully registered trademarks for its livery in key markets, including the United States, the United Kingdom, and the United Arab Emirates.

As the private jet operator pushes forward with its trademark efforts, industry observers are watching closely to see if adjustments to the application can meet the EU’s stringent trademark standards. The outcome could influence branding strategies for other aviation companies across Europe.
