2nd Circuit rules against hotel owner in pandemic BI case

The US Court of Appeals for the 2nd Circuit, in New York, has upheld a lower court decision that a Miami hotel owner cannot receive business interruption coverage for losses related to the coronavirus pandemic. The company “failed to allege the requisite ‘direct physical loss or damage’ to trigger coverage under” its commercial insurance policy, the court said.
